Public Notice December 5, 2016 City Council Minutes 4:30 P.M. A regular meeting of the City Council of the City of International Falls, Minnesota, was held in the Council Chambers of the Municipal Building on the 5th day of December, 2016 at the hour of 4:30 P.M. MEMBERS PRESENT: Councilors Briggs, Droba, Jaksa, Kalar, and Mayor Anderson. MEMBERS ABSENT: None. MOTION by Councilor Kalar to approve the agenda with the following addition under New Business: #6 - Determine the process to follow if there is a dispute over the interpretation of the City Charter, Councilor Jaksa (Council action) MOTION seconded by Councilor Droba and carried unanimously. MOTION by Councilor Briggs to approve minutes of the regular City Council meeting of November 21, 2016. Motion seconded by Councilor Droba and carried unanimously. MOTION by Councilor Droba to approve minutes of the special City Council meeting of November 22, 2016. Motion seconded by Councilor Briggs and carried unanimously. MOTION by Councilor Briggs to approve minutes of the special City Council meeting of November 29, 2016. Motion seconded by Councilor Droba and carried unanimously. MOTION by Councilor Kalar to adopt Resolution No. 71-16 approving payment of claims and accounts payable this 5th day of December, 2016. Motion seconded by Councilor Droba and carried unanimously. George Bell, 714 11th St., thanked the Mayor and Council for moving the direction of the street lamp by his home to reduce the glare in his home. MOTION by Councilor Droba to approve the Second Reading of Ordinance 19, Fifth Series, An Ordinance to amend Section 2-52 of the Code of Ordinances related to residency requirements for certain city employees for job-related necessity, specifically for firefighters and ambulance attendants. Motion seconded by Councilor Kalar and carried unanimously. Mayor Anderson noted that this would take effect upon publication. MOTION by Councilor Briggs to approve the Consent Agenda as presented: 1. Approve the 2017 schedule for regular meetings of the City Council 2. Approve 2017 license renewals, as presented Motion seconded by Councilor Droba and carried unanimously. MOTION by Councilor Kalar to approve the 2017 license renewals, as presented. Motion seconded by Councilor Jaksa and carried unanimously with Councilors Briggs and Droba abstaining from the claim for the VFW, Peter Graham Post #2948, due to a conflict of interest. MOTION by Councilor Kalar to approve the Public Works and Infrastructure Committee recommendation to approve the proposal/contract and 2016 down payment expenditure payable to Becker Arena Products, Inc. to upgrade the Kerry Park outdoor ice rink. Motion seconded by Councilor Droba and carried unanimously. MOTION by Councilor Droba to approve consultant proposal of $106,500 from Community Design Group (CDG) with WSB & Associates for professional services to update the Comprehensive Plan, Land Use Ordinance, and Subdivision Ordinance. Motion seconded by Councilor Jaksa. Mayor Anderson noted that this firm is $6,500 over budget. Motion carried 4-1 with Councilors Briggs, Kalar, Droba, and Jaksa voting "yea" and Mayor Anderson voting "nay." Mayor Anderson stated that he does not support this because he believes the other firm is more preferable and is under budget. MOTION by Councilor Briggs to accept and consent to Councilor Harley M. Droba's letter of resignation from the Center Ward Councilor position and declare a Council vacancy effective December 31, 2016 at 11:59 P.M. Motion seconded by Councilor Jaksa and carried unanimously. MOTION by Councilor Jaksa to accept the Center Ward Councilor application form, to begin advertising for the vacancy on Saturday, December 10, 2016, to conclude applications on Monday, January 9, 2017, and to conduct interviews of all applicants with dates and times to be determined. Motion seconded by Councilor Kalar and carried unanimously. MOTION by Councilor Jaksa to add to Council procedures that when there is a dispute over the interpretation of the City Charter that it be referred to the City Attorney for a legal opinion. Motion seconded by Councilor Briggs for discussion. Mayor Anderson stated that this was not necessary as the City Charter is very clear and calls for the Minnesota Statute 351.02 to be followed. Councilor Briggs, Kalar, and Droba agreed. Discussion ensued. Motion failed 1-4 with Councilor Jaksa voting "yea" and Mayor Anderson and Councilors Briggs, Kalar, and Droba voting "nay." Police Chief Mastin gave a brief report for November 2016. Fire Chief Mannausau gave a brief report for November 2016. Mayor Anderson handed out a summary sheet of recommendations from the Public Works and Infrastructure Committee from the meeting on November 28, 2016. Two items are still under review and two items were acted on by the Council: No parking request on 10th Avenue between 5th and 6th Streets. Committee has this under review awaiting other information. Committee has under review no parking on 5th Street from 7th Avenue to 8th Avenue seeking additional information. MOTION by Councilor Droba to advertise that the parking on the south side of 5th Street between 9th and 10th Avenues will be subject to Calendar Parking. Motion seconded by Councilor Briggs and carried unanimously. MOTION by Councilor Kalar to approve no parking on the north side of 5th Street from 8th to 9th Avenues allowing loading and unloading and that parking will be allowed on both sides of the 5th Street on days that St. Thomas Aquinas Hall is in use as a polling place. Motion seconded by Councilor Droba and carried unanimously. Councilor Droba thanked the Chamber of Commerce for the 'Twas the Lights Before Xmas Parade and all the departments involved with their assistance. Joe Schwartz, Chair of International Falls Recreation Commission, thanked the Council for voting to replace the boards at Kerry Park. Mayor Anderson reminded everyone that the next regular meeting is scheduled for Monday, December 19, 2016 at 4:30 P.M. and adjourned the meeting at 5:37 P.M. ATTEST: Robert W.
