PUBLIC NOTICE February 16, 2016 City Council Minutes 4:30 P.M. A regular meeting of the City Council of the City of International Falls, Minnesota was held in the Council Chambers of the Municipal Building on the 16th day of February at the hour of 4:30 P.M. MEMBERS PRESENT: Councilors Briggs, Droba, and Mayor Anderson MEMBERS ABSENT: Councilors Jaksa and Kalar MOTION by Councilor Briggs to approve the agenda with the following addition: Consent Agenda item #2: Year 2016 license Cater to You, LLC for an itinerant restaurant license New Business item: #7:Authorize Police Chief to acquire quotes for one (1) 2016 police package AWD or 4x4 SUV patrol vehicle, as a budgeted item. #8:Resolution No._-16 approving application for a 1 day to 4 day temporary on-sale liquor license for Knights of Columbus Council 1540 for April 2, 2016 at St. Thomas Aquinas Hall, 810 5th Street. Motion seconded by Councilor Droba and carried unanimously. MOTION by Councilor Briggs to approve minutes of the regular City Council meeting of February 1, 2016. Motion seconded by Councilor Droba and carried unanimously. MOTION by Councilor Droba to adopt Resolution No. 08-16 approving transfers, payment of claims and accounts payable for the second monthly City Council meeting. Motion seconded by Councilor Briggs and carried unanimously. Don Hughes, 915 8th St., expressed concerns of a vehicle not properly licensed, a vehicle parked in the same place all winter, and a trailer that has had a load of garbage on it all winter, and asked the Council to address these issues. MOTION by Councilor Droba to approve the Consent Agenda as presented: 1.Approve/allow necessary expenses for Public Works employees to attend HD Supply Waterworks meter sizing workshop in Hibbing, MN on February 25, 2016. 2.Year 2016 license Cater to You, LLC, itinerant restaurant license Motion seconded by Councilor Briggs and carried unanimously. MOTION by Councilor Briggs to adopt Resolution No. 09-16 approving Maintenance and Operations Grant from the State of Minnesota for the International Falls-Koochiching County Airport Commission. Motion seconded by Councilor Droba and carried unanimously. MOTION by Councilor Briggs to approve the Subordination Agreement of a Small Cities Development Program (SCDP) Housing Rehabilitation Deferred Loan Repayment Agreement and Mortgage previously issued to Shelly R. and Lee W. Peterson to allow refinancing a mortgage through TruStar Federal Credit Union. Motion seconded by Councilor Droba and carried unanimously. MOTION by Councilor Droba to adopt Resolution No. 10-16 approving application for a 1 to 4 day temporary on-sale permit for Rotary Club of International Falls for the annual men's hockey tournament at Kerry Park Arena on March 11-13, 2016. Motion seconded by Councilor Briggs and carried unanimously. MOTION by Councilor Briggs to adopt Resolution No. 11-16 approving application for a 1 to 4 day temporary on-sale liquor license for VFW POST 9641, Littlefork, MN for a benefit at the Union Hall, 509 3rd Street, International Falls, MN on April 2, 2016. Motion seconded by Councilor Droba and carried unanimously. City Administrator Anderson referred to an informational memo from the League of Minnesota Cities, which showed criteria that must be met in order for a public expenditure to be valid, and was looking for Council direction on whether or not a sponsorship to the International Falls Outdoor Expo was a proper expenditure. City Attorney Shermoen stated that it's a gray area whether it's proper or improper and that the City has helped with the advertising of the event in the past. Mayor Anderson said it's a good event and brings visitors to the area. Councilor Briggs pointed out that it is not a proper expenditure according to the LMC memo, but supports the request due to past practice. MOTION by Councilor Briggs to approve sponsorship request of the International Falls Outdoor Expo scheduled April 8 and 9, 2016. Motion seconded by Councilor Droba to open the item for discussion. Discussion ensued. MOTION by Councilor Briggs to Table this item to the March 7, 2016 Council Meeting to allow some time to develop guidelines on what will be sponsored from here forward. Motion seconded by Councilor Droba. City Attorney Shermoen agreed to work with City Administrator Anderson to determine criteria and develop guidelines. Motion carried unanimously. MOTION by Councilor Briggs to set a presentation on wetland rules and permitting by Craig Jarnot, Biologist, U.S. Army Corps of Engineers, for 1:30 P.M. on March 7, 2016. Motion seconded by Councilor Droba and carried unanimously. MOTION by Councilor Droba to authorize the Police Chief to acquire quotes for one (1) 2016 police package AWD or 4x4 SUV patrol vehicle, as a budgeted item. Motion seconded by Councilor Briggs and carried unanimously. MOTION by Councilor Droba to adopt Resolution No. 12-16 approving application for a 1 to 4 day temporary on-sale liquor license for Knights of Columbus Council 1540 in connection with the St. Thomas School Auction at the St. Thomas Aquinas Hall, 810 5th Street, International Falls, MN on April 2, 2016. Motion seconded by Councilor Briggs and carried unanimously. City Attorney Shermoen commended City Administrator Anderson on all his hard work and effort on making sure policies are followed. Dan McCarthy, International Falls resident, addressed the Council in regards to the contract between the City of International Falls and the Chamber of Commerce. He also noted that Councilors who are absent should have to state the purpose of their absence since they are elected officials, and that it should be required to use the microphone for anyone who wants to speak at City Council meetings so it can be part of the recorded minutes. City Administrator Anderson clarified that State law allows cities to make donations to the Chamber of Commerce up to $50,000 per year. Our Chamber of Commerce provides business retention and expansion, tourism promotion, as well as a number of other services. He also confirmed that the Chamber has a very detailed contract that outlines their forecasted hours they will expend in various capacities on behalf of the community and any expenditures that have been made thus far to the Chamber are lawful. James Robb informed the Council that the NKASD was approached last week by Kabetogama Township to bid on the operations and maintenance for their sewer project. He stated that the NKASD Board had their monthly meeting today and decided unanimously not to bid on the project.
