Public Notice March 20, 2017 City Council Minutes 4:30 P.M. A regular meeting of the City Council of the City of International Falls, Minnesota was held in the Council Chambers of the Municipal Building on the 20th day of March, 2017 at the hour of 4:30 P.M. MEMBERS PRESENT: Councilors Droba, Jaksa, Pearson and Mayor Anderson. MEMBERS ABSENT: Councilor Briggs MOTION by Councilor Droba to approve the agenda as presented. Motion seconded by Councilor Jaksa and carried unanimously. MOTION by Councilor Jaksa to approve minutes of both the regular City Council meeting of March 6, 2017 and the Committee-of-the-Whole and Project Steering Team Joint Meeting of March 13, 2017. Motion seconded by Councilor Pearson and carried unanimously. MOTION by Councilor Droba to adopt Resolution No. 17-17 approving transfers, payment of claims and accounts payable for the second monthly City Council meeting. Motion seconded by Councilor Jaksa and carried unanimously. Mayor Anderson presented the draft for the First Reading of Ordinance No. 20, Fifth Series, An Ordinance Prohibiting Excessive Vehicle Noise, Including Noise From Trucks Using Engine Retarding Brakes, and Adopting by Reference Minnesota Statutes, Sections 169.69 and 169.693 and Minnesota Rules, Parts 7030.1000 to 7030.1050. City Attorney Shermoen suggested adding "or" before (b) in Section 1, and Police Chief Mastin suggested removing "and does not comply with all applicable state laws and regulations" from Section 2. Brian Kilchesky, 1112 11th Street, stated this ordinance is simple to enforce and any vehicle can be red tagged for excessive noise and installing make-shift mufflers. MOTION by Councilor Jaksa to pass the First Reading of Ordinance No. 20, Fifth Series, with the suggested changes. Motion seconded by Councilor Droba and carried unanimously. Mayor Anderson scheduled the Second Reading for the April 3, 2017 regular City Council meeting. MOTION by Councilor Jaksa to approve the Consent Agenda as presented: 1. Approve travel and training expenses for Councilor Droba to attend the LMC Legislative Conference, March 23, 2017, St. Paul, MN 2. Approve travel and training expenses estimated at $5,265.88 for Firefighters Mortenson and Harris to attend FDIC International training on April 25 to 29, 2017, Indianapolis, IN 3. Approve travel and training expenses for Council and Administrator attendance at LMC Annual Conference on June 14 to 16, 2017, Rochester, MN Motion seconded by Councilor Pearson and carried unanimously. Mayor Anderson informed the public and Council that an "Open Book" meeting for a property owner to appeal property value/assessments is scheduled for May 10, 2017 from 9:00 a.m. to 12:00 p.m. at the Koochiching County Assessor's office. MOTION by Councilor Jaksa to write a Resolution of support and endorsement for Servants of Shelter to support their capital investment request for increased funding for affordable housing. Motion seconded by Councilor Droba. MOTION by Councilor Droba to Table this item until the April 3, 2017 City Council meeting to allow time to prepare the Resolution. Motion seconded by Councilor Pearson and carried unanimously. MOTION by Councilor Droba to approve and consent to the Mayor's appointment of Terry Murray to the NKASD Board of Directors for James Robb's vacant term ending January 31, 2019. Motion seconded by Councilor Pearson. Councilor Jaksa was not in support of this appointment stating that both Chrystal Clance and herself have stepped forward to serve on the NKASD Board and were not given the opportunity. Mayor Anderson said he did not receive an application from either interested party. Motion passed 3-1 with Mayor Anderson and Councilors Droba and Pearson voting "yea" and Councilor Jaksa voting"nay." MOTION by Councilor Droba to approve Employee Assistance Agreement between the Sand Creek Group, Ltd. and the City of International Falls, March 2017 to March 2018, for $2,722.50. Motion seconded by Councilor Pearson and carried unanimously. MOTION by Councilor Jaksa to approve acceptance of Minnesota Board of Firefighter Training and Education award of $5,000 for training reimbursement and authorize submittal of request for reimbursement for $7,200. Motion seconded by Councilor Droba and carried unanimously. MOTION by Councilor Jaksa to authorize and direct the City Attorney to review Chapter 6 of 2017 Minnesota Session Laws related to off-sale intoxicating liquor sales on Sunday in order to recommend updates/changes to Chapter 5, Liquor, Wine, and Beer Licensing and Regulation, in the Code of Ordinances. Motion seconded by Councilor Pearson and carried unanimously. Mayor Anderson handed out a Mayor's Report dated Monday, March 20, 2017. Mayor Anderson also thanked Diane Adams, Library Director, for the annual report, and reminded the Council that there is a tax abatement meeting at the County Board room tonight at 6:30 P.M.
