Public Notice MINUTE SUMMARY REGULAR MEETING OF THE KOOCHICHING COUNTY BOARD OF COMMISSIONERS Tuesday, Sept 5, 2017; 9:30 a.m. MEMBERS PRESENT: Commissioners McBride, Norby, Pavleck, Adee, Skoe MEMBERS ABSENT: None OTHERS IN ATTENDANCE: Jerry Struss, Bob Peterson, Dan McCarthy, Journal Reporter Whitney Jackson 000 The County Board approved the agenda for the September 5, 2017 meeting, approved the minutes from the August 29, 2017 regular meeting. 2017/09-03 Motion by Pavleck, seconded by Norby to reappoint Candance Ritch as the Koochiching County Veterans Service Officer for a four-year term effective November 13, 2017 under M.S. 197.60. Motion carried unanimously. 2017/09-04 Motion by Pavleck, seconded by Norby to approve the North Star Electric Cooperatives annual meeting on Friday, October 6th at the Littlefork/Big Falls School at 5:00 p.m. as a board activity. Motion carried unanimously. 2017/09-05 Motion by McBride, seconded by Skoe to approve Koochiching County Board Commissioners signatures to Auditor Rebecca Otto requesting the Office of State Auditor's cooperation in seeking a mutually agreeable solution to resolve concerns raised regarding audit standards. Motion carried unanimously. 2017/09-06 Motion by McBride, seconded by Norby to approve to revise the September meeting schedule, cancelling the September 26, 2017 Regular Board and Committee of the Whole meeting. Motion carried unanimously. 000 Small Cities Aid Committee Representative presented the board with an overview of the committee which was sanctioned by the KDA on April 4, 2017 to study the creation of a Small Cities Aid that would be funded from any Great Northern Transmission Line property tax assessments. The committee is made up of representatives from the cities of Big Falls, Littlefork, Mizpah, Northome and Ranier and County Representative Auditor/Treasurer Peterson. The Committee met twice and are proposing that 25% of the County's proceeds, after apportionment, from the Great Northern Transmission Line be dedicated on an annual basis for Small Cities Aid on the basis of the following percentages: Big Falls 23%, Littlefork 23%, Mizpah 8%, Northome 23% and Ranier 23%. County Auditor/Treasurer Peterson informed the board the County will not receive any increase in the tax capacity in 2018, a small increase in 2019, based on construction and the full increase in tax capacity in 2020 or 2021, further informing the board this is a state assessment and a powerline tax which is currently subject to 50% apportionment to the school districts and 50% to the county. Auditor/Treasurer added there is no indication on what the state will assess and further explained the powerline assessment adds to the County's tax capacity and the amount collected is dependent on the amount that is levied. Board Member asked what the funds could be used for and there was discussion that each city has unique needs and any funds will not be restricted. Board Member commented the small cities need assistance and acknowledged they have some disadvantages. 2017/09-07 Motion by Skoe, seconded by Norby to make a motion of intent to consider additional aid to the small cities of Big Falls, Littlefork, Mizpah, Northome and Ranier from a potential increase in tax capacity from the Great Northern Transmission Line property assessments as presented by the Small Cities Committee. Motion carried unanimously. 2017/09-08 Motion by Norby, seconded by Pavleck, adopting the following resolution to accept the high bid for the sale of the Koochiching County US Army Reserve Center in the amount of $300,000 as recommended by the County Attorney: RESOLUTION OF THE KOOCHICHING COUNTY BOARD OF COMMISSIONERS AUTHORIZING PUBLICATION OF NOTICE OF PUBLIC SALE AND FIXING TERMS OF SALE OF THE FORMER US ARMY RESERVE CENTER FOR KOOCHICHING COUNTY WHEREAS, Koochiching County ("County") is the owner of the real property and improvements commonly known as 1804 Third Avenue West, International Falls, Minnesota, comprising 5.84 acres, more or less, and formerly known as The Koochiching County US Army Reserve Center, as more particularly described, as follows (the real property and improvements hereafter collectively referred to as the "Property"): All of Block Five (5) and Six (6), Plat of First Division of International Falls, according to the plat thereof on file and of record in the Office of the Register of Deeds within and for Koochiching County, Minnesota, and That part of 4th Avenue West, and those alleys lying in Blocks Five (5) and Six (6), bounded on the North by the South right of way line of 18th Street, and bounded on the South by the North right of way line of 19th Street. WHEREAS, the County has determined that the sale of the Property is in the best interests of the County and its citizens. WHEREAS, the County has entered into that certain Development Agreement dated as of the 28th day of February, 2017, with Granite Digital Realty LLC, d/b/a its subsidiary, Granite Digital Realty ARC I, LLC, for the development of a data center business on the Property. WHEREAS, Minnesota Statutes Section 373.01, subd. 5, provides that any conveyance of an interest in real estate owned by the County shall require advertising for bids or proposals in the official newspaper of the County for three consecutive weeks and once in newspaper of general circulation in the area in which the affected property is located (the "Notice of Sale"). WHEREAS, Minnesota Statutes Section 373.01, subd. 5, further provides that the Notice of Sale shall state the time and place of considering the proposals, contain a legal description of any real estate and a brief description of any personal property involved in any contemplated sale of public land. WHEREAS, the County, by June 13, 2017 resolution, authorized the Notice of Sale in the International Falls Journal beginning Wednesday, July 5, 2017 and continuing for three weeks. WHEREAS, Granite Digital Realty LLC, d/b/a its subsidiary, Granite Digital Realty ARC I, LLC, submitted the highest bid of $300,000.00 for the purchase of the described property. NOW, THEREFORE, BE IT RESOLVED that the Koochiching County Board of Commissioners hereby authorizes the sale of the real property and improvements commonly known as 1804 Third Avenue West, International Falls, MN and appurtenant 5.84 acres, more or less, to Granite Digital Realty LLC, d/b/a its subsidiary, Granite Digital Realty ARC I, LLC, for the purchase price of $300,000. Motion carried unanimously. 000 The Board Chair called for public comment at 10:05 a.m. Dan McCarthy commented on the article published in The Daily Journal in regard to the Office of the State Auditor and requested a copy of the letter the County received from the Office of the State Auditor requiring the re-audit of 2015 and the office to perform the 2016 audit.
